Can you help Chase out anyone? 

 

I have a question regarding the new Technology law in MN.  I am wondering if you would know.

With school owned student devices are you able to monitor screens through a third party application like impero, securly, etc?

Or has that ability to monitor been taken away with the new law.  Here

MASA did a Master Class on this new law that was recorded. I would highly recommend watching the recording. I believe you can still use monitoring tools but there might be some changes in policy and practice. I think you can still use these tools. Here's a response to a similar question from Anthony Padrnos at Osseo Area Public Schools. Anthony testified on the legislation at hearings during the legislative session and has a very sound approach to it.

As we’ve reviewed this with our legal team and as we worked on the law with legislators tools such as Bark, GoGaurdian, Relay Alerts, etc. can still be used as long as it is being used to meet state law (ex: MN Safe Schools Act), Federal Law (ex: COPA), or funding requirements for e-rate (ex: CIPA). Besides meeting legal requirements, districts can also continue to use monitoring tools to provide instruction and technical support.

 

CIPA provides a very broad range of flexibility for school districts to ensure a safe online environment for students when using district provided internet connected resources with expectations by school districts that monitoring is occurring. The MN Safe Schools Act specifically calls out the requirements for districts to intervene/ prevent bullying/ harassment that occurs in the digital space.

 

You do need to be cautious and discuss what this means as a district should you start to have alerts and access student information around items that may be considered as “imminent threat to life or safety” as this may trigger the notification clause around “imminent threat to life or safety”.
